In this privacy statement, HAIL EUROPE B.V., registered in the trade register of the Chamber of Commerce under number 76914917, with statutory office in Alkmaar and business address at (1821 SE) Alkmaar, Barnsteenstraat no. 9, reachable at phone number +31 (0)72 - 520 50 68 and email address info@hail-europe.com, hereinafter referred to as ‘’HAIL EUROPE’’, explains which personal data it processes, for what purposes this personal data is processed, and on which legal basis. Additionally, HAIL EUROPE explains the rights an individual has among other things.

 

Introduction

Both on the websites (www.hail-europe.com and www.hail-europe.nl), hereinafter referred to as ‘’the websites’’), as well as in the exercise of its activities, HAIL EUROPE processes personal data. When processing personal data, HAIL EUROPE generally acts as the data controller in the sense of the General Data Protection Regulation (hereinafter referred to as ‘’GDPR’’). In cases where HAIL EUROPE does not determine the purpose and/or manner in which personal data is processed, it acts as a processor in the sense of the GDPR.

Common actions related to personal data include the collection, recording, storage, modification, retrieval, consultation, use, provision, and deletion of such information. HAIL EUROPE does not use automated processes to make decisions that could have significant consequences for individuals. This refers to decisions made by computer programs or systems without the intervention of human parties, such as employees of our organization.

The websites of HAIL EUROPE do not intend to collect data from individuals under the age of eighteen (18) unless they have obtained permission from their parents and/or legal guardians. However, HAIL EUROPE cannot verify if a visitor is under the age of eighteen. For this reason, HAIL EUROPE advises parents and/or guardians to be involved in the online activities of their children to prevent the collection of information about children without consent. - Customers of its products (hereinafter referred to as ‘’Customers’’);
- Website users (hereinafter referred to as ‘’Users’’).

Sharing of Personal Data

HAIL EUROPE will not provide personal data to third parties as a principle unless:

- The personal data is provided to processors engaged by us with whom a data processing agreement has been concluded, or independent data controllers, for example, IT, hosting, HR, or other service providers, external consultants, accountants, or lawyers;
- HAIL EUROPE is legally obliged to provide personal data to competent authorities, such as regulators or other public authorities;
- The personal data is provided to a company that is affiliated with HAIL EUROPE and/or a third party or within the company of HAIL EUROPE;
- Other third parties, provided explicit Consent has been given.

Sharing personal data with the aforementioned parties will only occur for the purposes outlined in this privacy statement, and within the boundaries of this privacy statement and the applicable laws and regulations. This also applies if HAIL EUROPE is legally required to hand over personal data to a competent authority. The parties that gain access to the personal data are responsible themselves for complying with privacy legislation. Therefore, HAIL EUROPE does not bear responsibility or liability for the processing of personal data by these involved parties.

 

Transfer of Personal Data Outside the European Economic Area

To facilitate the delivery of products and/or services, it may be necessary for HAIL EUROPE to transfer personal data to countries outside the European Economic Area (EEA). In situations where such transfer occurs, HAIL EUROPE takes all appropriate measures to ensure the legitimate transfer of personal data to these countries. These measures include entering into a (model) contract with the recipient outside the EEA, which has been approved by the European Commission or the relevant national regulator. This guarantees the lawful transfer and protection of personal data, and complies with the current privacy legislation.

POLL The ID of any polls you have recently voted in.
POLLN Information on what polls you have voted on.
RECENTLYCOMPARED The items that you have recently compared.
STF Information on products you have emailed to friends.
STORE The store view or language you have selected.
USER_ALLOWED_SAVE_COOKIE Indicates whether a customer allowed to use cookies.
VIEWED_PRODUCT_IDS The products that you have recently viewed.
WISHLIST An encrypted list of products added to your Wishlist.
WISHLIST_CNT The number of items in your Wishlist.

 

Retention Periods

Personal data processed by HAIL EUROPE will not be retained longer than strictly necessary for the purposes described in this privacy statement, unless required by law. For instance, administrative data will be kept for seven years, and personal data provided for the purpose of requesting a quote will be deleted once the offered quote is declined.

 

Technical and Organizational Security

Measures HAIL EUROPE has implemented effective technical and organizational security measures to safeguard the protection of individuals' personal data. These appropriate measures include, among others:

- Security of its servers to prevent unauthorized access;
- Equipping its computers with virus scanners and firewalls to enhance protection;
- Imposing code of conduct on its employees to maintain safety;
- Requiring its employees to maintain strict confidentiality to protect the data.

Furthermore, HAIL EUROPE also takes measures to protect individuals' personal data from data breaches. A data breach is defined as a violation, both unintentional and unauthorized, of security resulting in the loss of personal data, unlawful modification, unauthorized provision, or viewing.

Additionally, they have the right to request HAIL EUROPE to restrict processing and to transfer the data to another party. This means that data subjects have the right to receive the personal data that HAIL EUROPE has about them in a structured, commonly used, and machine-readable format, and possibly to transfer it to another organization.

Depending on the country in which the data subject resides and/or is based, they have the right to file a complaint with a supervisory authority overseeing compliance with personal data protection rules.
